    Switching gestor mid renewal, what handover to demand

My main demand for the new gestor, "LegalAssist Spain", was a clear, itemized list of all documents submitted *and* confirmed receipt numbers from immigration. You absolutely need those reference numbers. Beyond the obvious proof of submission, insist on a full copy of everything they've ever filed on your behalf. This includes your original DNV application, all related tax forms (Modelo 030, Modelo 730 if applicable), and any correspondence with the Spanish government. I made sure to get this electronically and as hard copies for my records. It sounds basic, but you’d be surprised what gets lost. LegalAssist was amazing and provided a full digital folder within 48 hours of taking over. Also, ask for a written timeline of expected next steps and potential delays. My previous gestor just shrugged when I asked about processing times for the DNV renewal. LegalAssist gave me a realistic 6-8 week window based on current Madrid processing, which has been spot on so far. Don't be shy about setting expectations for communication either.     It's funny you mention the hard copies. Everyone thinks Spain is 100 percent digital now but I've had the police at the TIE appointment demand the physical stamped papers from the original filing. If your old gestor only has digital files and won't give them to you, you are basically starting from scratch. Demand everything.

    That's why you should always do the 'presentacion' yourself if you can. It's not that hard if you have a digital certificate and can read some basic Spanish bureaucratic terms. Agencies charge way too much for what is essentially a file upload.

    Exactly. And make sure the digital files aren't password protected. I had a friend whose gestor locked all the PDFs before sending them over as a final petty move after being fired. It was a total mess to get them unlocked.

    Did your first gestor charge you the full fee upfront? I paid half for a renewal last month and I am glad I did because they have been so slow. If you are switching mid stream you should definitely demand a breakdown of what part of the fee was for the filing vs the follow up. Most wont refund you but it is worth a shot if they haven't actually hit the submit button yet.

    Getting the Modelo 030 is the most important part of what you mentioned. If you ever want to buy a car or do anything major, having that tax residency paper trail is vital. Most gestors just treat the DNV as a one-off task and forget the tax side. Did the new agency check if your social security payments were actually up to date? That's the main reason renewals get rejected in Madrid lately.

    Wait, did you already pay the full 2025 fee? If your email receipts show a huge amount for "fees" and they haven't done the work, you are probably not getting that back. Just make sure the new person is actually a registered "gestor administrativo" or a lawyer. There are way too many people on Instagram pretending to be experts who just disappear when the UGE asks for more documents.

    I'm curious if they charged you a 'takeover' fee. I tried to switch away from a bad lawyer last year and the new firm wanted 500 euros just to review the mess the first one made. It feels like you're stuck between a rock and a hard place when the clock is ticking on that 90 day window. Madrid is definitely taking closer to 3 months right now though, so that 6 to 8 week estimate might be a bit optimistic.

    Actually I think the 6 to 8 weeks is for the initial 'admitido a tramite' status lately. The final resolution is taking forever. I've been waiting since November for my renewal letter.

    I am in the middle of a renewal in Madrid too and honestly the lack of transparency from some agencies is wild. Make sure you get the submission receipt with the expediente number. Without that, you have no way to track it yourself on the Sede Electronica. If they refuse to give you the actual digital certificate file they used, you at least need the full PDF of every document they uploaded so the new person doesn't have to start from scratch.

    Good point on the digital certificate. Most of them use their own professional one though, so they wont hand that over. Just make sure they revoke their representation in the system or the new lawyer will get blocked when they try to file.

    Did LegalAssist mention anything about the social security registration? I had a nightmare switching in February because my first person didn't properly link my NIE to the right system. Even if they give you the submission numbers, you should double check that your digital certificate actually shows those files in the 'Mi Carpeta Ciudadana' portal. Don't just take their word for it.

    I had the exact opposite experience with a big agency. They gave me all the numbers and receipts but half of them were for the wrong person. It's a factory for some of these places. My advice is to check the actual name on every single PDF they give you during the handover. Don't just trust the folder names. I found out two weeks later I had some random guy's health insurance policy in my 'confirmed' folder.

    Weekly check-ins sound like a dream. My guy in Chamberi hasn't replied to a WhatsApp in ten days. I'm approaching my renewal and I think I'll look into LegalAssist. Did they ask you to sign a new hoja de encargo or a power of attorney? I'm worried about the legal cost of basically starting over.

    The most important thing to demand is the proof of payment for the 790 038 fee. If you already paid that tax and they do not give you the receipt, you will end up paying it twice with the new gestor. Madrid is picky about those forms. Also check the dates on your social security certificates. If they are older than 30 days the new gestor will just make you get them again anyway.

    I would ask for the specific login details if they set up a separate Cl@ve for you, though usually they just use their own lawyer certificate. If you are moving to a new agency, ask them for a list of what they need to "take over" the file. Some agencies have a specific template for a handoff. Madrid is move faster lately but a bad handoff can add months of delays if things get archived for missing info.

    Switching now for a 2025 renewal is risky because of the 90 day window. Make sure the new person knows exactly how much time is left on your current card. If the old gestor already submitted the application, you need the "justificante de presentacion" immediately. If they havent submitted it yet, just take your documents and run. Half these guys are just glorified translators anyway. Spain is a nightmare for paperwork.

    I had to do this last year. The "justificante" is literally the only thing that matters legally to show you are still in a regular situation. If they hold that hostage, tell them you will file a complaint with their professional college. they usually move fast after that.

    Glad you got out of that situation. Honestly the 300 euro fee for doing nothing sounds so typical for some of these agencies in Madrid. One thing people forget to ask for is the electronic certificate (Clave/Digital Certificate) if the gestor set it up on your behalf. If they have your digital signature and you leave on bad terms, you want to make sure you have full control over that file and they aren't still accessing your notifications.

    That is a huge point. If they created the certificate for you, they basically own your digital identity in Spain. You should revoke the old one and get a new one yourself at a social security office just to be safe.
